Monday Wake Up Call – Extremists in the Military Edition, February 22, 2021

For decades, domestic extremists have flaunted their ties to the US military, seeking to attach themselves both to the military’s credibility, and their tactical skills.

The January attack on the US Capitol showed us that the ties between US military members and the extreme right are deeper and more pervasive than we thought. Among the Capitol crowd were many military emblems: Some waved Marine Corps flags, many wore military gear, or specific unit patches signifying their time in service.

The AP found that at least 21 active-duty US Army and law enforcement personnel were present at the riot. We know that about 207 people have been arrested so far. The Military Times reported that 32 of the participants in the US Capitol coup had previously served in the military. If you want to get a current reading on the attitudes of the military to the Capitol coup, read the 640 comments on the article. It’s chilling.

How big is the problem? Last year, the FBI told the Pentagon that it had opened criminal investigations that involved 143 current or former service members. Sixty-eight of those involved domestic extremism and the vast majority involved veterans, not active-duty troops. Importantly, the Defense Department has no central database for tracking the allegations or disciplinary actions related to extremism.

Also, military regulations allow service members to have extremist affiliations and use extremist rhetoric if a service member doesn’t act upon them. In fact, the Pentagon reported in 2020 that only 21 service members had been disciplined or discharged over the previous five years for extremist activities. It’s doubtful that reflects the true scope of the problem.

According to a Pentagon report delivered to Congress last October:

“Despite a low number of cases in absolute terms, individuals with extremist affiliations and military experience are a concern to US national security because of their proven ability to execute high-impact events….Access to service members with combat training and technical weapons expertise can also increase both the probability of success and the potency of planned violent attacks.”

Military leaders say tackling the problem is difficult because the Constitution protects freedom of speech, and the law prohibits criminalizing affiliations that are deemed fundamentally political in nature, rather than a threat to harm the public. New defense secretary, Gen. Lloyd Austin, vowed at his confirmation hearing in January to:

“…rid our ranks of racists and extremists, and to create a climate where everyone fit and willing has the opportunity to serve this country with dignity.”

And Pentagon spokesman John Kirby told reporters on Feb. 3:

“Extremism has risen to a top priority as the new secretary called in the service secretaries and Joint Chiefs of Staff…directing them to conduct a 60-day stand-down for leaders to speak with troops about the problem….”

Monitoring the potential extremist activities of 1.3 million active-duty service members is challenging. It’s difficult to distinguish between the casual gestures of some troops and the real warning signs of potentially illegal extremist activity by others.

Another concern is that 35 US Capitol Police officers are being investigated for their actions during the Capitol riot, and six have been suspended. In addition, the NYT reports that at least 30 police from around the country took part in the rally before the Capitol riot. Many are being investigated, and three have been arrested on federal charges related to breaching the Capitol.

The military appears to be less politically representative of society, with a long-term downward trend in the number of officers identifying as Democrats. Instead, identification with the Republican Party has become the norm. The junior officer corps, apart from its female and minority members, appears to be overwhelmingly hard-right Republican. And military personnel have for the past decade been voting in greater percentages than the general population.

In many ways, the military and civilian police seem to have, as Samuel Huntington wrote in 1957, “the outlook of an estranged minority.”

Time to wake up America! We can’t bury our heads in the sand, hoping that the linkage between the military, our police, and groups like QAnon and the fringe of the GOP won’t grow stronger. We need to call out the problem whenever and wherever we see it.

Monday Wake Up Call – February 15, 2021

The impeachment trial is behind us, but the Big Lie of the 2020 election, that there was massive voting fraud, remains with us. That Lie is propelling Republicans in many states to try to minimize, or end entirely, mail-in voting.

Republicans have reason to worry. Mail-in voting alone constituted nearly half the votes cast in the 2020 election, a significant increase from previous years. This chart from 538 shows the remarkable decline in same-day voting in America:

Traditional same day, in-person voting has dropped from more than 90% of ballots cast in the 1990s to 60% in 2016, to just 28% in 2020. Early in-person and vote-by-mail now accounts for 71% of total voting.

Overall, despite the Big Lie, early and by mail voting was a remarkable success. It was less prone to errors than expected, and had almost zero documented fraud. As expected, 538 reports that absentee votes broke blue, Election Day votes, red. They only have data for 15 of the 50 states, but it is consistent:

“Biden won the absentee vote in 14 out of the 15 states (all but Texas), and Trump won the Election Day vote in 14 out of the 15 as well (all but Connecticut).”

Trump used this historic change in voting patterns to claim that Democrats used mail ballots to steal the election. Now, in a backlash to the historic trends in voter turnout, Republicans are again looking to make it more difficult to vote.

A new report by the Brennan Center for Justice shows that legislators in 33 states have introduced 165 bills to restrict voting rights. The proposals primarily seek to: a) limit mail voting access; b) impose stricter voter ID requirements; c) slash voter registration opportunities; and d) enable more aggressive voter roll purges.

Many of these bills parrot the same lies Trump used to claim the election was stolen. And they’re sponsored by the same state officials who backed Trump’s efforts to reverse the results of the election.

Remember how narrow the Biden win was: he won three states by a combined margin of 43,560 votes: Arizona (10,457 votes), Georgia (12,636 votes), and Wisconsin (20,467 votes). These three states have 37 electoral votes, and had Trump won all three, the Electoral College would have been tied, 269 to 269. Then the House would have determined the winner, with each state delegation getting one vote. Since the Republicans hold a majority of state delegations, Trump would have won a second term.

It was worse. The WaPo reports that

“Republicans came, at most, 43,000 votes from winning each of the three levers of power.”

Just 32,000 votes would have flipped control of the House to Republicans, while 14,000 votes would have kept control of the Senate in Republican hands. The Republicans have a built-in structural advantage in all three political levers of power: In the House it’s gerrymandering; in the Senate it’s the population imbalance favoring rural states; and in the White House, it’s the Electoral College.

So, beating back voting restrictions has to be a top priority.

Republicans have been restricting voting for years. We were lucky that state and local election officials acted in the best interests of the people and the country. That may not happen next time, so these anti-democratic pieces of legislation must be highlighted publicly and fought tooth-and-nail.

Think for a minute about last week’s impeachment trial: 34 GOP senators representing just 14.5% of the US population can block the conviction of an impeached president. Said another way, the 57 senators who voted to convict Trump represent 76.7 million more Americans than the 43 senators who voted to acquit him.

We should also remember that every state sets its own rules when it comes to voting and counting the votes. And we’ll soon see the impact of Republican gerrymandering, once the 2020 census is complete. The long-term solution is a Constitutional amendment that finally establishes that all citizens have the right to vote, and describes the approved methods of voting.

Monday Wake Up Call – February 8, 2021

Trump’s second impeachment trial starts tomorrow. There is the one charge, “incitement”, and the defenses to that charge will be tossed around a lot over the rest of the week.

The defense will start by saying that there can’t be a trial because Trump is no longer president. That will be shot down.

Beyond that, their main argument will be that Trump didn’t incite anyone, that he was simply exercising his Free Speech rights. They will argue that: Donald Trump did not say, “Invade the Capitol.” Donald Trump did not say, “Break windows.” Donald Trump did not say, “Engage in violence.” He did not say, “Insurrection.” He did not say, “Riot.”

He certainly didn’t say those things, so what’s the rebuttal to the argument?

The House impeachment managers need to make a case that regular people can understand about what incitement is, and what actions would meet a legal definition of incitement.

University of Michigan law professor Len Liehoff laid out the incitement legal criteria in the Detroit Free Press:

  • The speech must be directed toward producing action.
  • It must be likely to result in such action.
  • The action must be unlawful.
  • And the action advocated for must be imminent.

Liehoff explained using a Supreme Court case:

“…the law has developed a very specific and relatively narrow definition of incitement. That definition comes from the US Supreme Court’s 1969 decision in Brandenburg v. Ohio. In the case…Clarence Brandenburg addressed a gathering of Ku Klux Klan members in a field. In a speech that included racist and anti-Semitic remarks, Brandenburg bemoaned the fate of Caucasians, made a vague reference to “revengeance,” and announced that Klan members planned to march in Washington, DC on Independence Day.”

Liehoff goes on: (emphasis by Wrongo)

“The Court held that speech like Brandenburg’s could be criminally punished only where “such advocacy is directed to inciting or producing imminent lawless action and is likely to incite or produce such action.”

Liehoff explains the general idea: (emphasis by Wrongo)

“If I urge you to do something unlawful next Saturday, then you’ll have plenty of time to consider it and talk yourself out of it. But if I spur you to do something now, it tends to short-circuit the reasoning process. You don’t think, you just go.”

Trump’s words and actions on Jan. 6 meet these criteria. As Rep. Liz Cheney, (R-WY) said:

“There’s no question the president formed the mob, the president incited the mob. The president addressed the mob. He lit the flame.”

The unmistakable message was that people should go to the Capitol and disrupt the proceedings in an attempt to keep Trump in office. And that is unlawful conduct. The Senate really is deciding one question: Were the events that followed Trump’s rally the likely result?

Liehoff says they were the inevitable result.

The right loves to attack the left for their speech and actions. The Trump defense team has already said it plans to use videos of Democrats to create a false equivalency. They will attempt to show Democrats using inflammatory language during the BLM demonstrations last summer. They will try to use these same criteria to show Trump did nothing more than Democrats did. That’s untrue, and unequivalent.

The trial could take longer than expected, since David Schoen, a lead member of Trump’s defense team requested that the trial be suspended during the Jewish Sabbath so that he can meet his obligations as an observant Jew.

Will Trump be convicted for incitement? Probably not, since so many Republican Senators have already made up their minds. In essence, we’ll be watching a trial with a rigged jury.

So time to wake up America! Even if the Senate won’t convict, there are other pending cases against Trump. Remember that should he get convicted for money laundering, he won’t be able to hold public office either.

Monday Wake Up Call – Fire the Lawyers Edition, February 1, 2021

From CNN:

“…Trump’s five impeachment defense attorneys have left a little more than a week before his trial is set to begin, according to people familiar with the case, amid a disagreement over his legal strategy.”

CNN said that Trump wanted the attorneys to argue there had been massive election fraud and that the presidential election was stolen from him, rather than focus on the legality of convicting a president after he’s left office. Also, the attorneys had not been paid any advance fees and their letter of intent was never signed.

Isn’t it predictable that Trump will refuse to employ the only semi-sound legal strategy available to him? He has a valid defense to say he had no intention to foment sedition, and besides, the Senate has no jurisdiction, since he’s a private citizen.

But instead, he wants to employ, with zero evidence, the “election was stolen” defense.

The House impeachment article charges Trump with “incitement of insurrection” in the invasion of the U.S. Capitol on Jan. 6 by a pro-Trump mob. Let’s hope that Trump tries to represent himself. It’s possible that an incompetent defense that doesn’t address the charge may be sufficient to allow 17 Republicans to vote to convict him.

OTOH, Trump may not know the law, but he knows this jury.

What went down at the Capitol was an insurrection, not a cotillion. So let’s watch those Republican sycophants listen to him spout more bullshit that he’s completely and obviously unable to prove.

The election was stolen strategy forces Trump to make an argument that the insurrection was “justified”, however nothing in the 2020 election justifies insurrection. But, he would just love that platform. One more chance to put himself in front of the cameras, and play to his base. One more chance for them to declare Trump a victim.

But what would he say when being sworn in? He’s asked to swear to tell the truth, whole truth and nothing but the truth. Opinions differ.

There’s no reason he has to be represented by a lawyer. Impeachment is a political process, not a legal one. However, it is likely that ethics rules would cover the actions of a lawyer representing Trump at the impeachment trial. As non-lawyer, Trump would not be so constrained.

Testifying on his own behalf may be the best chance that enough Senate Republicans could be shamed into convicting him. Let him face 100 Senators with the argument that he actually won by millions of vapor votes.

Eventually, when there is a roll call vote, the choice is either to vote “Guilty” or “Not Guilty”. But the two real choices facing Republican Senators are “Do I show minimal integrity, or utter debasement?” We’ll see if once again, they’ll choose the latter.

Trump knows it’s likely that there are 45 Senate votes in the bag to acquit. He just wants to continue the Big Lie propaganda war. Trump’s already using the stolen election and attempted coup as a Creation Myth for his political movement.

But the facts of the case are well known to everyone. We were all eyewitnesses. And the Senate will vote according to some combination of conscience and political necessity, regardless of evidence or arguments.

If conviction of the one count of Impeachment doesn’t happen, let’s at least look forward to a criminal indictment of Trump on seditious activity. It could happen as the DOJ learns more about the coordination by the coup leaders, and their connection to Trump.

Time to wake up America! Once again we will take a roll call vote that shows how craven the Republican Party has become.

Monday Wake Up Call – Delay The Impeachment Trial Edition, January 25, 2021

It’s a smart idea for the Democrats to take their time getting to the impeachment trial. Despite what America saw on Jan. 6, what we know about actions on that day and any advance planning by the rioters or their enablers remains extremely murky.

It’s seems clearer now that the sedition at the US Capitol was part of the larger attempt to undermine and undo the results of the 2020 presidential election, but was it an organized effort?

If it was, what’s Trump’s part in it? How about others who were and are, working to ensure minority rule in America: Did they also have a role in the riot?

On Jan 19, the WaPo had a story about possible advanced coordination of the riot:

“Self-styled militia members from Virginia, Ohio and other states made plans to storm the U.S. Capitol days in advance of the Jan. 6 attack, and then communicated in real time as they breached the building on opposite sides and talked about hunting for lawmakers, according to court documents filed Tuesday.”

Wrongo was particularly interested in this from the article: (brackets and emphasis by Wrongo)

“In charging papers, the FBI said that during the Capitol riot, Caldwell [Thomas Edward Caldwell, a leader of the Oath Keepers extremist group] received Facebook messages from unspecified senders updating him on the location of lawmakers. When he posted a one-word message, “Inside,” he received exhortations and directions describing tunnels, doors and hallways, the FBI said.”

This is chilling: Some messages said:

“Tom, all legislators are down in the Tunnels 3 floors down,” and “Go through back house chamber doors facing N left down hallway down steps.” Another message read: “All members are in the tunnels under capital seal them in. Turn on gas…”

Not clear to Wrongo what “turn on gas” means in this context. But, it’s hard to imagine “turn on gas” coming from anyone already in the tunnels. OTOH, the other messages to the Oath Keeper leader, detailing where lawmakers were, came either from a member of Congress, or from staff to a member of Congress.

We should also understand that to the FBI, “unspecified” doesn’t mean “unknown”. With all the domestic communication that NSA gathers, we are certain to learn who sent these messages.

It will take further investigating to develop a detailed timeline annotated with the messages from/between members of the administration, members of Congress and the coup plotters. There are two possible outcomes they were likely driving toward:

  1. Hostages held in exchange for the Joint Session voting either to adjourn without a decision on the Electoral Votes, or voting to make Trump president again.
  2. They kill many, enabling Trump to invoke the Insurrection Act, which he uses then to remain in power indefinitely.

Would either have worked? Thankfully for our democracy, Trump & Co. were seemingly unable even to plan a one-car funeral.

Time to wake up America! There is nothing to be gained by fast-tracking the impeachment trial. There’s information that still needs to be gathered. We should wait and see what the FBI unearths.

Monday Wake Up Call – MLK Jr. Day -January 18, 2021

Dr. Martin Luther King Jr. helped lead marchers on March 21 to March 25 from Selma, Alabama to the state capital in Montgomery. It was their third attempt after a brutal crackdown by police on their first try on March 7, that caused the injuries that resulted in calling the first march “Bloody Sunday.”

On Aug. 6, President Lyndon Johnson signed the national Voting Rights Act of 1965. In 2013, the Supreme Court gutted the VRA, with its decision in Shelby County vs. Holder.

Since Martin Luther King Jr delivered his iconic “I have a dream” speech in August 1963, the number of Black Americans elected to the US Congress has dramatically increased. But it took until 2019, more than 54 years later, for the share of Black members serving in the House of Representatives to equal the percentage of Black Americans in the US population (12%).

To date, only seven states have sent a Black representative to the US Senate, and many states have never elected a Black representative to either House of Congress.

Here’s a look at Black representation in every US Congress since 1963:

A few words on the Voting Rights Act of 1965: Since the Voting Rights Act was gutted in 2013, 1,688 polling places have been shuttered in states previously bound by the Act’s preclearance requirement. Texas officials closed 750 polling places. Arizona and Georgia were almost as bad. Unsurprisingly, these closures were mostly in communities of color.

In December 2019, the House passed HR 4, the Voting Rights Advancement Act, now named the John R. Lewis Voting Rights Act, to restore the safeguards of the original VRA. It’s been collecting dust on Mitch McConnell’s desk ever since. He and his GOP colleagues continue to sit idly by as Republican state officials suppress the vote with no accountability.

If your vote didn’t count, they wouldn’t be trying so hard to suppress it. There’s no telling what change we’ll be able to make once we win the battle for voting rights.

So, time to wake up America! Change has to come. The fight didn’t start with Dr. Martin Luther King, Jr and it didn’t end with John Lewis. The fight continues. To help you wake up, listen again to Sam Cooke’s “A Change Gonna Come”. It was released as a single in December 1964.

Cooke was inspired by hearing Bob Dylan’s “Blowin’ in the Wind”, and was also moved by Dr. King’s August 1963 “I Have a Dream” speech. But it was Cooke’s experience in October 1963, when he and his entourage were turned away from a whites-only Holiday Inn in Shreveport, Louisiana, despite having reservations – that directly triggered him to write “A Change is Gonna Come.”

“Change” was released as a single two weeks after Cooke’s murder at age 33 on Dec. 11, 1964. It was quickly embraced by civil rights activists.

Still relevant, in so many ways, it’s possible to see it as a comprehensive review of the Trump administration. The linked video is as powerful to watch as the lyrics to Cooke’s song are to hear:

Monday Wake Up Call – Our Dangerous Future Edition, January 11, 2021

Look closely at the size of the crowd in the photo above, because our future may look a lot like that. The GOP has become two Parties, says Timothy Snyder in an excellent article in the NYT. He says that the Republican Party is now two coalitions of politicians and their supporters. One group wants to game the system, while the other wants to break the system.

What this portends for the immediate future, is chilling. The Breakers have moved on from the US Capitol to statehouses. Kentucky.com reported that dozens of heavily armed people gathered on Saturday outside the Kentucky Capitol building, demonstrating against socialism, communism, Sen. Rand Paul (R-KY), and Sen. Mitch McConnell (R-KY), along with Democratic Gov. Andy Beshear:

“Several members of the Kentucky State Police looked on as members of the group, composed of people from self-described “militias,” made speeches interspersed with live performances of country songs. Some in the crowd held flags or wore hats supporting President Donald Trump.”

By Wrongo’s count, that makes 12 state capitols that have seen militia-style demonstrations since the attempted coup at the US Capitol. We’ve entered a period when mobs of angry individuals now feel sufficiently emboldened to just go and break any law they disagree with.

We know that the Republican Party is culpable: By defending Trump’s big lie about a stolen election even after the Jan. 6 attempted coup, they’ve set a precedent: A Republican presidential candidate who loses an election should be appointed to the job anyway. For at least the Breaker branch of the Republican Party, they will operate in the future with two plans in mind: Plan A, to win the election. And Plan B, to lose, but then to win through force.

As with Ted Cruz and Josh Hawley’s objections to the Electoral Votes of certain states, a finding of election fraud isn’t necessary. Breaker Republicans will only need to hear allegations that there was fraud. More from Snyder: (emphasis by Wrongo)

“Post-truth is pre-fascism, and Trump has been our post-truth president. When we give up on truth, we concede power to those with the wealth and charisma to create spectacle in its place. Without agreement about some basic facts, citizens cannot form the civil society that would allow them to defend themselves. If we lose the institutions that produce facts that are pertinent to us, then we tend to wallow in attractive abstractions and fictions. Truth defends itself particularly poorly when there is not very much of it around…”

Snyder says that for the Republican Breaker faction to succeed, they need an angry minority, organized for nationwide violence, ready to add intimidation to an election. It is surprising just how close they are to having all of that in 2021. One more from Snyder:

“Informed observers inside and outside government agree that right-wing white supremacism is the greatest terrorist threat to the United States. Gun sales in 2020 hit an astonishing high. History shows that political violence follows when prominent leaders of major political parties openly embrace paranoia.”

How large is the cohort of Breakers? Wrongo hasn’t seen any estimates. But, a YouGov Direct poll of 1,397 registered voters who knew about Wednesday’s attempted coup found that 62% of voters perceived the mob action as a threat to democracy:

  • Democrats (93%) overwhelmingly see it this way.
  • Most Independents (55%) also agree.
  • 68% of Republicans didn’t think that mob violence to overturn an election was a threat to democracy.

One poll isn’t dispositive, but since Trump got 70 million votes, and 68% of them seemingly condone overturning an election, we’re dealing with nearly 50 million people. Not all of them will take up arms against their government. But if organized, it would be a very large and well-dispersed militia. One that communicates instantly via social media.

There is much to say about the tension between our First Amendment rights, and the use potential coup plotters and their enablers make of social media. Trump was permanently banned from Twitter, while the hard right social platform Parler has lost access to the Apple store and to Amazon’s server platform.

Freedom of speech is essential to a democracy, but using Twitter, Facebook and the far-right platforms to lie, and to organize armed resistance to our government, brings with it the danger that our democracy could fall to angry, armed people who believe the big lie.

Time to wake up America! We’ve become a pre-coup nation. All of the necessary conditions are in place: vast inequality, growing poverty, a stabbed-in-the-back narrative that a large segment of Republican voters believe, along with the storyline that a right-wing President was the victim of voter fraud.

Remember that the majority of police and members of the military are sympathetic to the right, not to the left. A very smart, would-be dictator who understands the keys to power could work to either freeze the military, or gain their cooperation.

And the Breaker group has several of those smart, ruthless people.

Monday Wake Up Call – The Republican’s Electoral Vote Ploy

This picture is a perfect metaphor for America at the start of 2021. What we see is beautiful, but it sits on top of a mega-volcano that could erupt at any time. This could describe what our nation sees in January.

Little in America works anymore. Friend of the blog Pat M. said that when she asked the food bank in her small coastal town on the New Jersey shore what they needed most, they said “diapers”. Her town is an upscale place that much like down-scale places across America, has citizens in desperate need.

Imagine being a mom in middle class America who can’t afford to diaper her baby….

Our politics (and our politicians) have failed our people. There’s plenty of proof of that: The hard-hearted inability of Congress to pass relief legislation until it may have been too late for some. And the so-far disastrous federal rollout of the coronavirus vaccine proves that the Trump administration is incompetent at their jobs.

Democracy now starts its first week of 2021 living dangerously. We knew that a few Republicans would object to the counting of the Electoral Votes of certain states. That the certification of Electoral Votes would be delayed to handle objections by politically motivated back-benchers in both Houses of Congress. This game plays out on Wednesday. We’ll watch Republicans attempt to throw out enough of the votes of Americans in a few states, to keep Trump in power.

That effort will fail, but we should see it for what it is. There’s a through line from impeaching Bill Clinton, to refusing Obama’s Supreme Court nominee Merrick Garland a hearing, to Republicans in Congress refusing to confirm the election of Joe Biden. From Paul Campos:

“The logical and perhaps inevitable extension of the principle ‘we won’t confirm any Democratic Supreme Court nominee if we have the votes to block it’ is ‘we won’t confirm any Democratic winner of a presidential election if we have the votes to block it.’”

Republicans don’t have the votes to block Biden right now, but it’s one of their goals for the  future. Back to Campos:

“…Don’t fall for the claim that Mitch McConnell in particular was powerless here: The Senate majority leader has enormous formal and informal power to sanction deviationist members, by for example stripping committee assignments, blocking pet legislation, calling big soft money donors etc…”

From the NYT:

“Vice President Mike Pence signaled support on Saturday for a futile Republican bid to overturn the election in Congress next week, after 11 Republican senators and senators-elect said that they would vote to reject President-elect Joseph R. Biden Jr.’s victory when the House and Senate meet to formally certify it.”

The NYT normally pulls its punches, but this article speaks of “unambiguous results,” that every state has “certified the election results after verifying their accuracy,” and that Republicans have attempted to question those results by “offering vague suggestions that some wrongdoing might have occurred” and amplified them via “specious claims of widespread election rigging that have been debunked and dismissed.”

That the Times says straight out that the GOP wants to overturn the election doesn’t matter at all to today’s Republican Party.

Our social and political systems depend on the maintenance of informal norms as much as they depend on adherence to formal rules. Our most basic norm is the assumption that sociopaths are and will remain, unable to control our systems. We count on society’s guardrails to keep us from flying off the track. Here’s something to think about:

  • All of Congress were elected in November, including those Republicans who are objecting to the election results.
  • Among the Senators signing onto the effort are: Steve Daines (R-MT), and Senators-Elect Cynthia Lummis (R-WY), Roger Marshall (R-KS), Bill Hagerty (R-TN), and Tommy Tuberville (R-AL), all elected in November.

All are objectors to Biden’s election, but none of them are objecting to their own wins on the same day, on the same ballots, using the same election systems.

“Democracy depends on a willingness to transfer power peacefully from one group of leaders to another. By revealing that they refuse to do so, the members of the “Sedition Caucus,” as they are being called on social media, are proving they are unworthy of elected office.”

Wake up America! The next time you see a Republican lose it when an athlete takes a knee during our National Anthem, remind them that they sat back and watched Trump and his supporters attempt to dismantle our democracy.

Monday Wake Up Call – Sedition Edition, December 21, 2020

Maggie Haberman of the NYT reported the scary details of a meeting at the White House on Friday. During the meeting, Trump tried to hire Sidney Powell as special counsel to continue the investigation into Trump’s claims of voter fraud. He also asked advisors about declaring martial law, an idea floated by Michael Flynn, the general he recently pardoned.

The meeting’s attendees included Powell, Flynn, and Rudy Guilani via phone, along with White House counsel Pat Cipollone and Chief of Staff Mark Meadows. In addition to talk of martial law and Sidney Powell obtaining special counsel status and a top-level security clearance, Giuliani floated the idea of Trump issuing an executive order to commandeer Dominion Voting Systems voting machines. Giuliani had previously called Ken Cuccinelli, number two at the Department of Homeland Security (DHS), and asked him whether DHS could seize voting machines. Cuccinelli said that DHS didn’t have that authority.

Haberman reported that Meadows and Cipollone strenuously and repeatedly objected to these suggestions, saying they had no constitutional basis for going forward. Apparently, the meeting lasted several hours, and things got pretty heated. More from Haberman:

“The meeting got raucous, with various administration members drifting in and out and different people arguing. Powell told others they were quitters…”

The Washington Times, a right-leaning newspaper in DC reported that on Saturday, the military said it wants no part in the martial law discussion. Army Secretary Ryan McCarthy and Army Chief of Staff Gen. James McConville said in a joint statement:

“There is no role for the US military in determining the outcome of an American election,”

This shows how weak our government really is. With the right people supporting Trump, he could have attempted a military coup and overturned the election. This also shows how seditious Trump has become in the wake of his election loss. Thinking about, and possibly calling for, troops to stop a democratically elected president from taking office have taken his voter fraud claims to a much darker and militaristic place.

Since Trump has been thinking about suspending the Constitution and invoking martial law to overturn the election, he and his associates are committing seditious acts that should be treated accordingly.

America needs to make the price Trump pays for thinking about sedition higher than his price for accepting Biden’s win.

Now would be a good time for Biden to state publicly that attempts to violate election laws, or undermine democracy through overt and/or covert acts will be investigated by his DOJ, and that they will go wherever the evidence leads.

There are practical problems to think about: how will the incoming Biden team deal with a Trump administration that simply won’t agree to leave? Trump has stooges at the Department of Defense and the Justice Department. The Pentagon has already called a halt to transition activities, ostensibly until after Christmas, but who really knows?

What if Lloyd Austin, Biden’s new Secretary of Defense shows up at the Pentagon, and is denied entrance? Who does Biden appeal to? Trump? What happens when Trump refuses to take Biden’s call?

Does Biden ask the DOJ to step in? Trump’s stooge is sitting there as well. Does Biden ask the Supreme Court to intervene? What happens next?

None of us have any idea what’s going to happen between now and January 20th, but we need a concerted effort to strengthen the guardrails of our democracy. Trump has exposed just how weak our safeguards are.

The US is one month away from inaugurating a president who will follow established norms and conventions. There’s one more month for Trump to try martial-lawing his way out from under the nastiness that awaits him upon his leaving MAGAstan.

Time to wake up America! Trump has already tried several non-military coups, from trying to influence state electors, to multiple lawsuits attempting to throw out election results. It’s not really a question of what Trump is willing to do. And he’s not going to give up. We left “peaceful, dignified transfer of power” behind several weeks ago.

Monday Wake Up Call – December 7, 2020

What’s it gonna take for America to wake up to the Republican’s ongoing attempted coup? From the WaPo:

“Just 27 congressional Republicans acknowledge Joe Biden’s win over President Trump a month after the former vice president’s clear victory of more than 7 million votes nationally and a convincing electoral-vote margin that exactly matched Trump’s 2016 tally.”

A team of 25 Post reporters contacted aides for every Republican by email and phone asking three questions: 1) Who won the presidential contest? 2) Do you support or oppose Trump’s continuing efforts to claim victory? 3) If Biden wins a majority in the Electoral College, will you accept him as the legitimately elected president? Most refused to answer. Here are the WaPo’s findings in a chart:

When 215 of the 249 Republicans in Congress (86%) refuse to answer whether Biden would be the legitimately elected president, we’re looking at an attempted coup. These people aren’t waiting to get all the facts, or let the process play out. We shouldn’t be calling it anything else.

Just three state elections were really close — that is, decided by less than a one percent margin: Arizona, Georgia, and Wisconsin. Biden won all of them. The only semi-close state that Trump won was North Carolina, by a 1.3% margin. But had the three really close states gone for Trump, we would be looking at an Electoral College (EC) tie, 269-269. Then the House would re-elect Trump, thanks to the Constitutional process for breaking Electoral College ties, which gives each state one vote in the House to determine the next president.

Republicans control a majority of the seats in 26 House delegations, Democrats control 22, with two split evenly. That would mean a Trump re-election. It’s important to again emphasize that the EC would then have overturned the clear will of the people, showing how terribly flawed the EC truly is.

Since Republicans are still unwilling to say Biden won, even though all three of those states have certified him as the winner, imagine what we would be going through today if a single state hung in the balance?

And if the election had come down to a margin of a few thousand votes in Pennsylvania, you better believe the Supreme Court would have happily voted to toss out enough votes to provide a Republican victory. We shouldn’t feel sanguine about Biden’s clear victory.

We saw this in Wisconsin. Their Supreme Court just had a couple of 4-3 decisions on ridiculous cases brought by Trump, cases that argued for decisions that would be contrary to their constitution. Three of the four Republican judges voted with Trump anyway. Fortunately, one Republican judge actually cared a little about the law. That’s just too close.

And Politico is reporting that Rep. Mo Brooks, (R-AL) plans to challenge the Electoral College votes when Congress moves to certify Joe Biden’s victory on January 6. He’s looking for a Senator to join his challenge, though he noted that doing so would largely be a symbolic, and not practical, undertaking.

Time to wake up America! Our democracy is hanging by a thread. Despite Biden receiving more votes than any other president, despite getting the largest vote percentage against an opponent since 1932 (when Roosevelt defeated Hoover), Trump is still trying to overturn the election. And most Republicans are silent or looking the other way, hoping Trump succeeds.
